These Terms and Conditions ("Terms") govern your use of ApparelAI Studio ("Service"), operated by Baruzo Tech ("we," "us," or "our"), accessible at www.apparelai.app and app.apparelai.studio.
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.
1. Service Description
ApparelAI Studio is an AI-powered virtual photoshoot platform that transforms product photos (flat lays, hanger shots, mannequin images) into professional, studio-quality model photoshoots. The Service includes:
•AI model generation and garment photography.
•Persistent AI model creation and management.
•Batch image processing and generation.
•Video clip generation from AI photoshoots.
•Integration with e-commerce platforms (Shopify, WooCommerce, Amazon).
2. Account Registration
To use the Service, you must create an account. You agree to:
•Provide accurate and complete registration information.
•Maintain the security of your account credentials.
•Notify us immediately of any unauthorized access to your account.
•Accept responsibility for all activities that occur under your account.
You must be at least 18 years old to create an account and use the Service.
3. Subscription Plans, In-App Purchases, and Pricing
Available Plans
•Pro Plan ($9/month or $89/year): 50 credits per month, 3 persistent models, full background library.
•Growth Plan ($34/month or $349/year): 200 credits per month, 5 persistent models, full background library.
•Business Plan ($79/month or $799/year): 500 credits per month, unlimited persistent models, catalog generation.
•Agency Plan ($199/month or $1,999/year): 1,500 credits per month, unlimited persistent models, catalog generation, priority support.
Each subscription grants access to the corresponding quota of AI photoshoot images and features for the billing period stated (one month or one year from the date of purchase). Prices shown apply to the web platform; prices on the iOS App Store and Google Play may differ due to local taxes, currency conversion, and store-specific pricing tiers, and the price displayed in the app at the time of purchase is authoritative.
Billing, Payment, and Auto-Renewal
•Subscriptions are billed monthly or annually, depending on the plan selected. Payment is due at the beginning of each billing cycle.
•Web purchases are processed through our third-party payment processor. All prices are in USD unless otherwise stated.
•iOS in-app purchases and subscriptions are processed by Apple through your Apple ID:
- Payment will be charged to your Apple ID account at the confirmation of purchase.
- Your subscription automatically renews unless auto-renewal is turned off at least 24 hours before the end of the current period.
- Your account will be charged for renewal within 24 hours prior to the end of the current period, at the price of the selected plan.
- You can manage your subscription and turn off auto-renewal at any time by going to your Apple ID Account Settings on your device after purchase.
- Any unused portion of a free trial period, if offered, will be forfeited when you purchase a subscription to that publication, where applicable.
- No cancellation of the current subscription is allowed during the active subscription period on iOS - cancellation takes effect at the end of the current billing cycle.
•Android in-app purchases and subscriptions are processed by Google Play through your Google account and are governed by Google Play's terms. You can manage or cancel subscriptions in the Google Play Store under Subscriptions.
•We reserve the right to change pricing with 30 days notice for web subscriptions; changes to App Store or Google Play pricing will follow each store's notification process.
Cancellation and Refunds
•Web subscriptions: You may cancel at any time through your account settings. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial billing periods. Unused credits or images do not carry over after cancellation.
•iOS subscriptions: Cancellations and refund requests must be handled through Apple. Manage subscriptions in Settings > [your name] > Subscriptions. Refunds are at Apple's sole discretion and are governed by Apple Media Services Terms. We are unable to issue refunds for purchases made through the App Store.
•Android subscriptions: Cancellations and refund requests must be handled through Google Play. Manage subscriptions in the Google Play Store under Subscriptions. Refunds are at Google's sole discretion and are governed by Google Play's refund policy.
•Deleting the app from your device does not cancel an active subscription; you must cancel through the relevant store or your account settings.

Before completing any subscription purchase, you acknowledge that you have read and agree to these Terms of Use (EULA) and our Privacy Policy. Copies of both documents are always available at www.apparelai.app/terms-and-conditions and www.apparelai.app/privacy-policy.
4. Acceptable Use
You agree not to use the Service to:
•Upload or generate content that is illegal, harmful, threatening, abusive, defamatory, or obscene.
•Create images that infringe on the intellectual property rights of others.
•Generate content depicting real individuals without their consent.
•Attempt to reverse-engineer, decompile, or extract the AI models or algorithms.
•Use automated tools (bots, scrapers) to access the Service without authorization.
•Overwhelm the Service with excessive requests intended to degrade performance.
•Resell, sublicense, or redistribute the Service without written permission.
•Use the Service for any purpose that violates applicable laws or regulations.
5. Intellectual Property
Your Content
•You retain ownership of all images you upload to the Service.
•You grant us a limited license to process your images solely for the purpose of providing the Service.
•We do not claim ownership of your uploaded content or generated outputs.
Generated Outputs
•AI-generated images created through the Service are licensed to you for commercial and personal use.
•You may use generated images on your e-commerce platforms, marketing materials, social media, and print.
•You may not claim that AI-generated images are traditional photographs if platform policies require disclosure.
Our Intellectual Property
•The Service, including its AI models, algorithms, software, design, and branding, is owned by us.
•You may not copy, modify, distribute, or create derivative works based on the Service itself.
•"ApparelAI," the ApparelAI logo, and related marks are our trademarks.
6. AI-Generated Content Disclaimer
•AI-generated images are approximations. Minor variations in color, fit, drape, and detail may occur between AI outputs and actual products.
•You are responsible for verifying that AI-generated images accurately represent your products before publishing.
•We are not liable for customer complaints, returns, or disputes arising from inaccuracies in AI-generated imagery.
•AI outputs should complement, not replace, accurate product descriptions and specifications.
6A. User Liability for Generated Content
You are solely and fully responsible for all content you generate using ApparelAI Studio. This includes, without limitation:
•Prohibited use of real faces: You must not upload photographs, images, or likenesses of real individuals (including celebrities, models, actors, influencers, public figures, or any third party) as reference images for AI model creation without obtaining their explicit, documented written consent.
•Likeness rights: You acknowledge that using a real person's face or likeness without authorization may violate their personality rights, publicity rights, right to privacy, and other applicable laws. ApparelAI Studio has no obligation to verify whether you hold such rights.
•Full liability: You are fully liable for any and all legal claims, lawsuits, regulatory actions, fines, damages, losses, or consequences arising from your use of AI-generated content, including claims related to unauthorized use of likeness, defamation, intellectual property infringement, or violation of any applicable law.
•No liability for ApparelAI: ApparelAI Studio provides the technology platform only. We do not review, approve, or endorse the content you generate. We bear no responsibility or liability for how you use generated images.
•Indemnification: You agree to defend, indemnify, and hold harmless ApparelAI Studio, its officers, directors, employees, and affiliates from any claims, damages, or expenses (including legal fees) arising from your generated content or your violation of any third-party rights.
•Account termination: We reserve the right to immediately suspend or permanently terminate any account found to be generating content that depicts real individuals without proper authorization, or that infringes upon any person's rights.
7. Data and Privacy
Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to the collection and use of information as described in the Privacy Policy.
8. Service Availability
•We strive to maintain 99.9% uptime but do not guarantee uninterrupted access.
•We may perform scheduled maintenance with reasonable advance notice.
•We are not liable for service interruptions caused by factors beyond our control (natural disasters, third-party outages, cyber attacks).
9. Limitation of Liability
To the maximum extent permitted by law:
•The Service is provided "as is" and "as available" without warranties of any kind.
•We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
•We are not liable for any indirect, incidental, special, consequential, or punitive damages.
•Our total liability to you shall not exceed the amount you paid us in the 12 months preceding the claim.
10. Indemnification
You agree to indemnify and hold us harmless from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:
•Your use of the Service.
•Your violation of these Terms.
•Your violation of any third-party rights.
•Content you upload or generate through the Service.
11. Modifications to Terms
We may modify these Terms at any time. Material changes will be communicated via:
•Email notification to your registered email address.
•Prominent notice on the Service.
Continued use of the Service after changes constitutes acceptance of the modified Terms.
12. Termination
We may suspend or terminate your account if you:
•Violate these Terms.
•Engage in fraudulent or illegal activity.
•Fail to pay subscription fees.
•Use the Service in a manner that could harm our platform or other users.
Upon termination:
•Your access to the Service will be immediately revoked.
•Your uploaded images and generated content will be deleted within 30 days.
•You remain responsible for any outstanding payments.
13. Governing Law
These Terms are governed by and construed in accordance with the laws of India. Any disputes arising from these Terms shall be resolved through the courts of Ahmedabad, Gujarat, India.
14. Dispute Resolution
Before pursuing legal action, you agree to attempt to resolve disputes through:
1.Direct communication with our support team at support@apparelai.studio.
2.Good-faith negotiation for a period of 30 days.
3.If unresolved, disputes shall be submitted to binding arbitration under Indian Arbitration and Conciliation Act.
15. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
